Maintaining that a Federal Communications Commission regulation creates a private right of action under 42 U.S.C. § 1983, Ronald and Donna Loschiavo appeal from the district courts grant of summary judgment in favor of the City of Dearborn. The City of Dearborn, in turn, cross-appeals the district courts grant of a permanent injunction precluding city enforcement of a zoning ordinance regulating the installation of satellite dish antennas. For the following reasons, we reverse the grant of summary judgment to the City and affirm the district courts entry of a permanent injunction.
